These Terms of Service and Conditions ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and CrewLink World LLC, a Washington State Limited Liability Company ("CrewLink World," "Company," "we," "us," or "our"), governing your access to and use of the CrewLink World mobile application, website, and all related services (collectively, the "Platform"). By accessing or using the Platform in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST IMMEDIATELY CEASE ALL USE OF THE PLATFORM.

1. ACCEPTANCE OF TERMS

By creating an account, accessing, or using the CrewLink World Platform, you represent and warrant that: (a) you are at least 18 years of age; (b) you have the legal capacity to enter into a binding contract; (c) your use of the Platform does not violate any applicable law or regulation; and (d) all information you provide is accurate, current, and complete. CrewLink World reserves the right to modify these Terms at any time. Continued use of the Platform following any modification constitutes your acceptance of the revised Terms.

2. DESCRIPTION OF SERVICES

CrewLink World is a social networking platform designed exclusively for airline crew members, pilots, flight attendants, and aviation industry professionals. The Platform provides features including but not limited to: social media posting, direct messaging, group chatrooms, layover planning, city check-ins, crew discovery, and an aviation marketplace. CrewLink World reserves the right to modify, suspend, or discontinue any feature or the entire Platform at any time without notice or liability.

3. USER ACCOUNTS AND ELIGIBILITY

To access certain features of the Platform, you must register for an account. You agree to: (a) provide accurate and truthful registration information; (b) maintain the security of your account credentials; (c) promptly notify CrewLink World of any unauthorized use of your account; and (d) accept responsibility for all activities that occur under your account. CrewLink World reserves the right to suspend or terminate any account at its sole discretion, with or without notice, for any reason including but not limited to violation of these Terms.

4. USER CONDUCT AND RULES OF CONDUCT

4.1 Prohibited Activities

Users are strictly prohibited from engaging in any of the following activities on the Platform:

(a) Posting, sharing, uploading, or transmitting any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable;

(b) Impersonating any person or entity, or falsely claiming affiliation with any airline, aviation authority, or organization;

(c) Posting content that infringes upon or violates any third party's intellectual property rights, privacy rights, or any other rights;

(d) Engaging in harassment, bullying, intimidation, or stalking of any other user;

(e) Transmitting spam, chain messages, unsolicited commercial communications, or any form of automated messaging;

(f) Uploading or transmitting viruses, malware, or any other malicious code;

(g) Attempting to gain unauthorized access to any part of the Platform or any other system;

(h) Using the Platform for any illegal purpose, including but not limited to fraud, money laundering, or distribution of illegal substances;

(i) Collecting or harvesting personal data of other users without their explicit consent;

(j) Posting content that depicts, promotes, or facilitates violence, terrorism, or illegal activity;

(k) Using the Platform to solicit minors or engage in any form of child exploitation;

(l) Engaging in any activity that disrupts, interferes with, or places an unreasonable burden on the Platform's infrastructure.

4.2 Explicit Content and Violence — Zero Tolerance Policy

CREWLINK WORLD MAINTAINS A STRICT ZERO TOLERANCE POLICY TOWARD PORNOGRAPHIC, SEXUALLY EXPLICIT, AND GRAPHICALLY VIOLENT CONTENT. THIS POLICY IS ABSOLUTE AND NON-NEGOTIABLE. VIOLATIONS WILL RESULT IN IMMEDIATE PERMANENT ACCOUNT TERMINATION AND MAY RESULT IN REFERRAL TO LAW ENFORCEMENT AUTHORITIES.

The following categories of content are strictly and expressly forbidden on the Platform under all circumstances:

4.2.1 Prohibited Sexual and Pornographic Content

• Any pornographic, sexually explicit, or adult content of any kind, including but not limited to nudity, sexual acts, or sexually suggestive imagery

• Any content that depicts, promotes, solicits, or facilitates prostitution, sex trafficking, or sexual exploitation

• Any content that sexualizes, exploits, or endangers minors in any way whatsoever, including but not limited to child sexual abuse material (CSAM)

• Any non-consensual intimate imagery, commonly known as "revenge porn," or any content that violates another person's sexual privacy

• Any content designed to solicit sexual acts, sexual contact, or sexual communication from other users

• Any sexually explicit language, imagery, or innuendo directed at other users without their explicit consent

The posting, sharing, or distribution of child sexual abuse material (CSAM) is a federal crime under 18 U.S.C. § 2256 and will be reported immediately to the National Center for Missing and Exploited Children (NCMEC) and to federal law enforcement authorities without exception.

4.2.2 Prohibited Violent Content

• Any graphic violence, gore, or gratuitous depictions of injury, death, or bodily harm

• Any content that glorifies, promotes, incites, or threatens violence against any person, group, or animal

• Any content that promotes, glorifies, or facilitates terrorism, mass violence, or hate crimes

• Any content depicting animal cruelty or abuse

• Any content that instructs, encourages, or facilitates self-harm or suicide

• Any threats of violence, whether direct or implied, against any individual or group

• Any content that promotes, glorifies, or recruits for violent extremist organizations or ideologies

4.3 Consequences for Violations

CrewLink World's response to violations of Section 4.2 is as follows:

• FIRST OFFENSE — Immediate permanent termination of the user's account with no right of appeal, no refund of any fees paid, and permanent ban from the Platform

• ILLEGAL CONTENT — Immediate reporting to appropriate law enforcement authorities, including but not limited to local police, the FBI, and the National Center for Missing and Exploited Children (NCMEC) as required by law

• CIVIL LIABILITY — CrewLink World reserves the right to pursue civil legal action against users who post illegal content or content that causes harm to other users or to the Company

• COOPERATION WITH AUTHORITIES — CrewLink World will fully cooperate with any law enforcement investigation and will provide all available user data as required by law or court order

CREWLINK WORLD LLC, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS BEAR ABSOLUTELY NO RESPONSIBILITY OR LIABILITY FOR ANY PROHIBITED CONTENT POSTED BY USERS. THE USER WHO POSTED SUCH CONTENT IS SOLELY AND EXCLUSIVELY LEGALLY RESPONSIBLE FOR THEIR ACTIONS AND THE CONSEQUENCES THEREOF.

4.4 Content Reporting

CrewLink World encourages users to report any content that violates this policy. If you encounter pornographic, sexually explicit, graphically violent, or otherwise prohibited content on the Platform, please report it immediately by contacting us at crewlinkworldllc@gmail.com with the subject line "Content Violation Report." CrewLink World will investigate all reports and take appropriate action, which may include removal of content, account termination, and referral to law enforcement.

4.5 Account Termination for Other Violations

CrewLink World reserves the right, in its sole and absolute discretion, to immediately suspend or permanently terminate any user account found to be in violation of these Terms, without prior notice and without refund of any fees paid. Users whose accounts are terminated for violations may be permanently banned from the Platform. CrewLink World may also report violations to law enforcement authorities where appropriate.

5. USER-GENERATED CONTENT

5.1 User Responsibility for Content

YOU ARE SOLELY AND EXCLUSIVELY RESPONSIBLE FOR ALL CONTENT THAT YOU POST, UPLOAD, PUBLISH, TRANSMIT, OR OTHERWISE MAKE AVAILABLE THROUGH THE PLATFORM ("USER CONTENT"). CREWLINK WORLD LLC AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES BEAR NO RESPONSIBILITY WHATSOEVER FOR ANY USER CONTENT POSTED ON THE PLATFORM.

By posting User Content on the Platform, you represent and warrant that: (a) you own all rights to the content or have obtained all necessary permissions and licenses; (b) the content does not violate any applicable laws or regulations; (c) the content does not infringe upon any third-party rights; and (d) you assume full legal responsibility for the content and any consequences arising from its posting.

5.2 Content License

By posting User Content on the Platform, you grant CrewLink World a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, distribute, and display such content solely for the purpose of operating and improving the Platform.

5.3 Content Monitoring

CrewLink World does not pre-screen User Content and is not obligated to monitor the Platform for inappropriate content. However, CrewLink World reserves the right, but not the obligation, to remove any User Content at its sole discretion that it deems to violate these Terms or that is otherwise objectionable. CrewLink World's decision to remove or not remove content does not constitute an endorsement or approval of any User Content.

5.4 Reporting Violations

Users may report content that they believe violates these Terms by contacting CrewLink World at crewlinkworldllc@gmail.com. CrewLink World will review reported content and take appropriate action at its sole discretion.

6. INTELLECTUAL PROPERTY

6.1 Company Ownership

The Platform, including but not limited to its software, code, design, architecture, logos, trademarks, service marks, trade names, graphics, text, images, audio, video, and all other content created by CrewLink World (collectively, "Company Content"), is the exclusive property of CrewLink World LLC and is protected by United States and international intellectual property laws, including copyright, trademark, patent, and trade secret laws.

6.2 Restrictions on Use

You may not: (a) copy, reproduce, distribute, or create derivative works of Company Content without prior written permission from CrewLink World; (b) reverse engineer, decompile, or disassemble any software component of the Platform; (c) remove or alter any copyright, trademark, or other proprietary notices; (d) use the CrewLink World name, logo, or trademarks in any manner without prior written consent; or (e) frame or mirror any part of the Platform without express written consent.

6.3 Feedback

Any feedback, suggestions, or ideas you provide to CrewLink World regarding the Platform may be used by CrewLink World without any obligation to compensate you, and you hereby assign all rights in such feedback to CrewLink World.

7. DISCLAIMER OF WARRANTIES

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. CREWLINK WORLD EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

CrewLink World does not warrant that: (a) the Platform will be uninterrupted, error-free, or secure; (b) any defects or errors will be corrected; (c) the Platform is free of viruses or other harmful components; (d) the results obtained from using the Platform will be accurate or reliable; or (e) the quality of any content, services, or information obtained through the Platform will meet your expectations.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CREWLINK WORLD LLC, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

(a) Your access to, use of, or inability to use the Platform;

(b) Any conduct or content of any third party on the Platform, including any defamatory, offensive, or illegal conduct of other users;

(c) Any content obtained from the Platform;

(d) Unauthorized access, use, or alteration of your transmissions or content;

(e) Any malfunction, error, interruption, or defect in the Platform;

(f) Any damages arising from interactions between users of the Platform.

IN NO EVENT SHALL CREWLINK WORLD'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR YOUR USE OF THE PLATFORM EXCEED ONE HUNDRED DOLLARS ($100.00 USD).

9. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless CrewLink World LLC, its owners, officers, directors, employees, agents, licensors, service providers, and successors from and against any and all claims, damages, obligations, losses, liabilities, costs, debts, and expenses (including but not limited to attorneys' fees) arising from: (a) your use of the Platform; (b) your User Content; (c) your violation of these Terms; (d) your violation of any third-party rights, including intellectual property rights or privacy rights; or (e) any claim that your User Content caused damage to a third party. This indemnification obligation survives termination of these Terms and your use of the Platform.

10. PRIVACY

Your use of the Platform is also governed by our Privacy Policy, which is incorporated herein by reference and available at crewlinkworld.com/privacy-policy. By using the Platform, you consent to the collection, use, and sharing of your information as described in the Privacy Policy. CrewLink World reserves the right to disclose user information to law enforcement authorities when required by law or when CrewLink World believes in good faith that such disclosure is necessary to protect the rights, safety, or property of CrewLink World or others.

11. DISPUTE RESOLUTION AND ARBITRATION

11.1 Governing Law

These Terms and any dispute arising out of or related to these Terms or the Platform shall be governed by and construed in accordance with the laws of the State of Washington, United States of America, without regard to its conflict of law provisions.

11.2 Mandatory Arbitration

ANY DISPUTE, CLAIM, OR CONTROVERSY ARISING OUT OF OR RELATING TO THESE TERMS OR THE BREACH, TERMINATION, ENFORCEMENT, INTERPRETATION, OR VALIDITY THEREOF, OR THE USE OF THE PLATFORM, SHALL BE DETERMINED BY BINDING ARBITRATION ADMINISTERED BY THE AMERICAN ARBITRATION ASSOCIATION ("AAA") IN ACCORDANCE WITH ITS COMMERCIAL ARBITRATION RULES. The arbitration shall be conducted in Washington State, or at a mutually agreed location. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

11.3 Class Action Waiver

YOU WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. ALL DISPUTES MUST BE BROUGHT ON AN INDIVIDUAL BASIS ONLY.

11.4 Exception for Injunctive Relief

Notwithstanding the foregoing, CrewLink World may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or confidential information.

11.5 Time Limitation on Claims

Any claim or cause of action arising out of or related to use of the Platform or these Terms must be filed within one (1) year after such claim or cause of action arose, or be forever barred.

12. MARKETPLACE AND TRANSACTIONS

The Platform may include a marketplace feature allowing users to buy and sell aviation-related items. CrewLink World is not a party to any transaction between users and bears no responsibility for: (a) the quality, safety, legality, or accuracy of items listed; (b) the ability of sellers to sell or buyers to pay; (c) any disputes between buyers and sellers; or (d) any loss or damage arising from transactions. Users engage in marketplace transactions entirely at their own risk.

13. THIRD-PARTY LINKS AND SERVICES

The Platform may contain links to third-party websites, services, or content. CrewLink World does not endorse, control, or assume any responsibility for any third-party content, products, or services. Your interactions with third parties are solely between you and such third parties, and CrewLink World shall have no liability for any loss or damage arising from such interactions.

14. MODIFICATIONS TO THE PLATFORM

CrewLink World reserves the right to modify, suspend, or discontinue the Platform or any portion thereof at any time, with or without notice. CrewLink World shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Platform.

15. TERMINATION

CrewLink World may terminate or suspend your access to the Platform immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

16. SEVERABILITY

If any provision of these Terms is found to be unenforceable or invalid under applicable law, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, shall be severed from these Terms, and the remaining provisions shall continue in full force and effect.

17. ENTIRE AGREEMENT

These Terms, together with the Privacy Policy and any other legal notices published by CrewLink World on the Platform, constitute the entire agreement between you and CrewLink World concerning your use of the Platform and supersede all prior agreements, understandings, representations, and warranties.
